General booking conditions

These General Booking Conditions (hereinafter General Conditions) will regulate the commercial relationship arising between PURE SALT LUXURY HOTELS, and its associated companies as listed at the end of this document, and the user or client for bookings made through the forms that PURE SALT LUXURY HOTELS makes available on its websiteswww.puresaltluxuryhotels.com,www.puresaltgaronda.com,www.puresaltportdesoller.com, andwww.puresaltportadriano.com.

Booking through the PURE SALT LUXURY HOTELS websites will imply the express acceptance, by the client or user of the pages, of these conditions, as well as the conditions of use established for the user’s Browse of pages owned by PURE SALT LUXURY HOTELS.

These conditions will apply without prejudice to the application of legal regulations on the matter that are applicable in each case.

The General Contracting Conditions regulate the distance selling relationship between PURE SALT LUXURY HOTELS and the user or client, in accordance with legal stipulations, especially, Law 7/1998, of 13 April, on General Contracting Conditions, Law 3/2014, of 27 March, which modifies the consolidated text of the General Law for the Defence of Consumers and Users, Organic Law 15/1999, of 13 December, on the Protection of Personal Data, General Data Protection Regulation, Law 7/1996, of 15 January, on Retail Trade Organisation, and Law 34/2002, of 11 July, on Services of the Information Society and Electronic Commerce.

PURE SALT LUXURY HOTELS reserves the right to make modifications it deems appropriate, without prior notice, to the General Conditions. Such modifications may be made, through its websites, by any legally admissible means and will be binding during the time they are published on the website and until they are validly modified by subsequent ones. Nevertheless, PURE SALT LUXURY HOTELS reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it deems it appropriate, announcing them in a timely manner.

Information prior to booking

PURE SALT LUXURY HOTELS informs that the booking procedure through its websites is detailed in the corresponding section for formalising the booking.

Likewise, PURE SALT LUXURY HOTELS informs that the user can access the conditions of use that it makes available on the same website.

By booking with PURE SALT LUXURY HOTELS through its website, the user or client expressly declares to know, understand, and accept said conditions of use and the General Conditions. Similarly, the user declares to be of legal age and to have the necessary legal capacity and ability to access the PURE SALT LUXURY HOTELS websites and to contract through them. The user is responsible for treating the identity and password obtained during client registration confidentially and responsibly, and may not transfer them to another.

Once the booking is made, the user will see their booking confirmation on screen, and can print this as proof of the booking made.

The booking confirmation and the booking voucher (printout made by the user) will not be valid as an invoice.

Booking process

Booking offers and price references.

In compliance with current regulations and, in particular, Law 34/2002 on information society services and electronic commerce, PURE SALT LUXURY HOTELS offers information on all possible bookings, their characteristics and prices in the corresponding section for formalising the booking. Nevertheless, PURE SALT LUXURY HOTELS reserves the right to withdraw, replace, or change the offers made to its clients through its website, by simply changing their content. In this way, the products and/or services offered at any given time by the PURE SALT LUXURY HOTELS websites will be governed by the General Conditions in force in each case. Likewise, the company will have the power to stop offering, without prior notice and at any time, access to the products and/or services mentioned.

Price indication.

Each possible booking offered will indicate its price and if it includes VAT or any other applicable tax. The prices indicated on screen will be those in force at any given moment, save for typographical error. When the price is different for the reason stated above, PURE SALT LUXURY HOTELS will communicate this to the client, via e-mail, before proceeding with the booking charge.

Availability.

The availability of the offers presented by PURE SALT LUXURY HOTELS through its website may vary depending on client demand. Although PURE SALT LUXURY HOTELS updates the database periodically, the booking requested by the client might be full at that moment. In such a case, PURE SALT LUXURY HOTELS will send an e-mail to the client informing them of the unavailability of the offer.

Payment methods.

PURE SALT LUXURY HOTELS requests credit card details, belonging to the booking holder, for bookings made through its website to guarantee its effectiveness. The card is stored complying with PCI DSS regulations.

PURE SALT LUXURY HOTELS informs that, at the time of viewing the offers, the payment method will be determined.

Bookings with Payment on arrival:

We remind you that the establishment does not charge your credit card when making this booking. The card is used solely as a guarantee.

Likewise, the establishment reserves the right to check the validity of the credit card before the client’s arrival. The invoice corresponding to the booking will be settled directly at the establishment, either in cash, by credit card, or by any other method accepted by the establishment.

Additionally, if the client requests it, they can pay before check-in by bank transfer or by card via a secure payment link sent by email.

Bank Transfer

When selecting bank transfer, you will receive confirmation via an e-mail with the hotel’s bank details.

It is very important that when making the transfer, you indicate the reference number, as well as your full name, in the subject line, and make the transfer within 3 days of the confirmation date to ensure validation.

If you wish, you can send us the proof of transfer by email to the hotel’s reservations email address. However, in any case, the validation of the service will not be considered effective until our administration department has bank confirmation of the transfer.

Please remember that payment must be made in Euros and that all eventual exchange and bank commissions are at your expense.

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer you always inform your bank to cover the commissions at the origin, those bank commissions and expenses corresponding to your entity.

Otherwise, the hotel could halt the contracted service by not receiving the full amount.

Any potential exchange and bank commissions are to be borne by the client.

Non-refundable bookings:

In the event of a non-refundable booking, 100% of the booking amount will be charged via the payment gateway. No refund is allowed in case of cancellation, early departure, or no-show (the booking would only be held for the first night). If payment is denied, the hotel would cancel your booking.

Bookings with deposit:

If a deposit is required to guarantee the booking, it will be charged during the booking process by bank card.

Travel Agency Bookings

PURE SALT LUXURY HOTELS has a dedicated website for B2B sales. Please consult its booking conditions atwww.puresaltpro.com.

For those guests who enjoy additional services or extras during their stay, they can pay at the time of consumption or, if they wish to accumulate credit, they must provide their card number.

Cancellation of the booking.

Please consult the specific conditions of your booking to ascertain the period in which cancellation without charge / with deposit refund is permitted.

The cancellation of a non-refundable booking does not entail any refund.

Similarly, your booking conditions will indicate what the charges will be in case of a no-show without prior cancellation.

Right of withdrawal.

As established in article 103 of Law 3/2014, of 27 March, which modifies the consolidated text of the General Law for the Defence of Consumers and Users, the supply of services or goods made to the consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, are exempt from the right of withdrawal.

Data protection

Unless you notify us otherwise, we will understand that your data has not been modified, that you undertake to notify us of any variation, and that we have your consent to use them for the purposes mentioned.

PURE SALT LUXURY HOTELS informs that it will proceed to process the data in a lawful, fair, transparent, adequate, relevant, limited, accurate, and updated manner. This is why PURE SALT LUXURY HOTELS undertakes to adopt all reasonable measures to ensure that these are deleted or rectified without delay when inaccurate.

In accordance with the rights conferred upon you by current data protection regulations, you may exercise the rights of access, rectification, limitation of processing, erasure, portability, and opposition to the processing of your personal data as well as the consent given for their processing, by directing your request to the postal address indicated above or to the email address dpo@mac-hotels.com.

You may contact the competent Supervisory Authority to file any complaint you deem appropriate.

Applicable Law and Jurisdiction

Likewise, PURE SALT LUXURY HOTELS reserves the right to bring any civil or criminal actions it deems appropriate for the improper use of its website and contents or for the breach of these conditions.

The relationship between the user and the provider will be governed by the current and applicable regulations in Spanish territory. Should any controversy arise, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard. PURE SALT LUXURY HOTELS has its registered office in ILLES BALEARS, Spain.

Right of admission

We reserve the right of admission. Always acting reasonably, PURE SALT LUXURY HOTELS may deny entry or request the departure of any person (whether client or guest) whose presence or behaviour may negatively affect the enjoyment, safety, or well-being of other clients or staff. This includes, but is not limited to: inappropriate or undesirable behaviour, disturbances of the peace, use of violent, aggressive, threatening, offensive or discriminatory language, as well as insults or disruptive actions. Action may also be taken in cases where legal proceedings have been initiated against any of our establishments in the past, unauthorised access to restricted areas, or non-compliance with the internal rules of the accommodation.

These actions may result in the immediate and permanent expulsion of the establishment, cancelling all contracted services without the right to refund or compensation, including unused days. No costs for alternative accommodation or return transport will be assumed either.

We also reserve the right to undertake legal action against any person who causes damage to the facilities or furniture, or who exhibits posters, signs, or any visible manifestation that may be considered offensive or threatening. Likewise, action may be taken against anyone who has caused justified complaints from other clients, or attempts to access the facilities without the identification bracelet or corresponding authorisation in the case of all-inclusive establishments. Should the offender be part of a group, we reserve the right to apply these measures to the entire group if deemed necessary.

Behaviour and conduct policy

All clients must behave with respect towards staff, the facilities, and other guests. We ask that you take care of common areas and rooms so that everyone can enjoy the surroundings in optimal conditions. Any type of excessive noise, especially during the night, or attitudes that may cause discomfort, are strictly prohibited. Offensive, illegal, or behaviour contrary to the establishment’s rules will not be tolerated. Any client who engages in such conduct may be expelled without the right to refund or compensation. It is prohibited to smoke (including electronic cigarettes) in all indoor areas and in outdoor spaces designated as smoke-free. Individuals who, under the influence of alcohol, act irresponsibly — especially in relation to the care of minors in their charge — may be immediately expelled. The consumption, possession, or signs of use of illegal substances will lead to expulsion and prohibition of access, also without any compensation. Our facilities have security cameras intended to facilitate the proper functioning of the complex. Nevertheless, we are not responsible for the scope or content of the recordings.

Liability for damages

We reserve the right to claim from the client the costs of any damage or harm caused to the facilities or to other guests as a result of inappropriate behaviour, including legal expenses and compensation. Likewise, we may include the responsible client as an involved party in any legal action initiated by third parties if it is demonstrated that there was negligence or misconduct on their part or by persons associated with their booking.
